TxCHP Participation Waiver

In consideration of being permitted to participate in the Texas Christian Homeschool Prom all participants and volunteers (hereinafter referred to as "Family") agree to the following:

  1. Family acknowledges admission to prom requires purchase of a Prom Ticket or redemption of a Companion Voucher AND satisfaction of Family Service Credit (FSC) requirements.
  2. Release, waive, discharge, and covenant not to sue either the Texas Christian Homeschool Prom, Embassy Suites Convention Center and Spa, The City of Frisco, or any other location of Prom activities, (herein referred to as “Prom Activity Locations”), their officers, employees, board members or other families participating in the Texas Christian Homeschool Prom (hereinafter referred to as “Releasees”) from all liability to Family for any loss or damage and any claim or damage on account of injury to the person or property or resulting in death of a Family member, whether caused by the negligence of Releasees or otherwise. Family is willingly participating in activities of Texas Christian Homeschool Prom or any other activities on the premises of Prom Activity Locations.
  3. Family agrees to indemnify Releasees from any loss, liability, damage, or cost Releasees may incur due to the presence of Family in or on the premises of Prom Activity Locations.
  4. Family assumes full responsibility for and risk of bodily injury, death or property damage due to negligence of Releasees or otherwise while in or on the premises of Prom Activity Locations and/or while working or for any purpose participating in the activities of the Texas Christian Homeschool Prom.
  5. Family expressly agrees that this release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of the State of Texas and that if any portion of the agreement is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
  6. Family, in consideration of being permitted to participate in the Texas Christian Homeschool Prom, for Family, and Family’s heirs, executors, administrators, and assigns, releases and forever discharges all Releasees, and their heirs, administrators, and executors of and from any and every claim, demand, action or right of action, of whatsoever kind of nature, either in law or in equity arising from or by reason of any bodily injury or personal injuries known or unknown, death or property damage resulting or to result from any accident which may occur as a result of participation in the Texas Christian Homeschool Prom or any activities in connection with the Texas Christian Homeschool Prom, whether by negligence or not.
  7. Family grants to the Texas Christian Homeschool Prom and its successors and assigns, the right to use and publish for educational or other purposes, photographic likenesses or pictures of Family taken at the Prom or at Prom-related events and activities.
  8. Family releases all officials and professional personnel from any claim whatsoever on account of first aid, treatment or service rendered Family during participation in the Texas Christian Homeschool Prom.
  9. Family acknowledges that behavior at TxCHP events must conform to TxCHP’s Biblical moral, ethical, and behavioral standards. Family agrees to abide by all TxCHP policies, including its Code of Conduct and Dress Code.
  10. The parties agree that any claim or dispute arising from or related to this agreement shall be settled by biblically based mediation and, if necessary, legally binding arbitration in accordance with the Rules of Procedure for Christian Conciliation of the Institute for Christian Conciliation. Judgment upon an arbitration decision may be entered in any court otherwise having jurisdiction. The parties understand that these methods shall be the sole remedy for any controversy or claim arising out of this agreement or any dispute arising out of any activities or events associated with the Texas Christian Homeschool Prom and expressly waive their right to file a lawsuit in any civil court against one another or against another Texas Christian Homeschool Prom family for such disputes, except to enforce arbitration decision. Both parties enter into this waiver of jury trial and alternative dispute resolution agreement voluntarily, knowingly, and willingly, having had the opportunity to confer with counsel and choosing to enter into this Agreement nonetheless.
  11. This agreement shall be binding on each member of the Family, their personal representatives, assigns, heirs, and next of kin.
  12. This release contains the entire agreement between the parties to this agreement and the terms of this release are contractual and not a mere recital.
  13. Family states that both Parents (or Legal Guardians) of Family have carefully read the above release and know the contents of the release and agree to this release as Family’s own free act.
  14. Family understands, acknowledges, and agrees that all purchases are non-refundable and agrees not to dispute the refundability of any purchases made in connection with Texas Christian Homeschool Prom.
  15. By attending any TxCHP event, you voluntarily assume all risks involving going to a public place and related to exposure to COVID-19 and any of its variants.
